Court says board must allow Yankee question on ballot

BRATTLEBORO — The Windham Superior Court has ruled in favor of Brattleboro resident Kurt Daims, who challenged the Selectboard’s decision to not include a controversial question regarding Vermont Yankee nuclear power plant on the town ballot for all residents to vote on at the 2010 Town Meeting.

The board made the decision in January when it approved the Town Meeting warning. Daims had urged the board to send to voters the question of whether the state should investigate whether it can take Vermont Yankee in Vernon by eminent domain as a method of determining exactly how much it will cost to decommission the plant when it shuts down.

The petition was submitted by Daims and the local group EMDOVY (eminent domain over Vermont Yankee.)

The board voted 4-1 against adding it to the ballot, with Dora Bouboulis the only board member voting in favor…

In a written decision filed Sept. 8, the court stated that “the Selectboard should have included this advisory article in the warning for Town Meeting….

Daims said he would like to see the article put up for a townwide vote during the General Election in November.

“It’s on schedule for that,” he said. “Then people can start to talk about it, and maybe go for it — for the resolution — so that the state Legislature can look into this new angle on Vermont Yankee.”

The court’s ruling leaves it up to the board and Daims to agree on a remedy for the board’s misstep. If they cannot reach an agreement within 20 days of the date of the order, Daims can return to court with a motion seeking his desired remedy.
